TERMS OF SERVCIE

By using the platform, opening an account or by clicking and accepting or agreeing to the terms and conditions when the option is provided, you accept and agree, on behalf of yourself, your employer, your organization or any other entity or institution to be bound and abide by the terms and conditions of Connection Muhimu Network provided below. If you do not want to agree to these terms of service, you must not access or use the platform. Connection Muhimu Network reserves the right to use all published and delivered works on the platform for marketing and promotional purposes.

Key Term Definitions

1. Connection Muhimu Network: Means the website, the marketplace with the domain name www.connectionmuhimunetwork.com
2. Account: Means the account associated with your email address or username
3. User, you, your: Means an individual, who has created an account on the platform, can be the seller or the buyer of the freelance service. Can also mean an individual who is just browsing through the platform without creating an account.
4. Seller/vendor: Means a freelancer who has created an account that allows them to create their skill portfolio to be selected for a job.
5. Buyer/customer: This is a user who has created an account to purchase freelance service or post a gig opportunity on the platform
6. Buyer/customer Account: means an account that allows for purchase of freelance servicers on the platform, this account also allows you to advertise a job opportunity to the sellers on the platform
7. Platform, website, site: means connection muhimu network
8. Freelance service: means a service offered by a seller or being purchased by buyers on the platform.
9. Freelancer: Means a user on the platform who sells a freelance service
10. Gig/product: Means a job opportunity or service offered by a freelancer or provided by a buyer.
11. Custom orders: are requests made by a buyer to receive a custom offer from a seller
12. Custom offers: are exclusive proposals that a seller crates in response to a custom order.
13. Order: this is a formal agreement between buyer and seller to commence the work for the chosen service, a gig changes to become an order once a buyer makes the payment which will then allow the seller to commence work.
14. Completed Order/orders: this is a delivered order, service, job or gig and accepted by the buyer.
15. Registration: is the act of creating an account on the platform.
16. Registered users: a user on the platform, can be a seller or buyer of the services, who has created their account on the platform.
17. Payment: this is the amount credited to the seller’s account after an order is delivered and completed.
18. Portfolio/Shop: is the product catalog created by the vendor/freelancer in their account, available on the freelancers page to be viewed and ordered by customers/buyers

1.      ELIGIBILITY

The platform is available and offered to users of legal age; 18+ years. A user who is below the legal age is permitted to use and access the platform through an account owned by a parent, guardian or person of authority and of legal age in their lives with the appropriate permission. if you are under the legal age, you are not allowed to use the platform and services offered by Connection Muhimu Network.

Only registered users may buy and sell services on Connection Muhimu Network. You are not allowed to create an account for fraudulent activities. In creation of your account, you agree to provide us with accurate, complete and updated information as requested during the registration.

You are solely responsible for the confidentiality of the activities in your account, this includes the privacy and security of your account password

Connection Muhimu Network is not liable for any acts, activities, omission or any other activity in connection with your account.

A user with a suspended account due to complaints filed by other users on the platform is not permitted to access the services on the platform.

A company, trust, cooperation, or any other entity can create a corporate account by subscriptions, whose terms and conditions are discussed and agreed upon with Connection Muhimu Network.

You cannot transfer or assign any obligation or right under this agreement to a third part without prior written consent.

2.      SELLERS

Sellers create portfolios/services/products to allow buyers to purchase their services on the platform.

Sellers may also create a custom offers in response to a custom order created by a buyer on a specific gig, service or job.

The sellers’ account is credited with the payment once the order is marked as completed.

The seller’s rating is calculated based on the reviews posted by the buyers on their account after connection. A seller is not allowed to rate or review their own services. High ratings allows seller to receive advanced seller levels. In special cases, extremely low ratings may lead to account suspension.

Each gig/job/product or service sold on the platform will be charged a 10% transaction fee that will be deducted during payment of the service after order is complete.

Pro-freelancers or sellers are hand-picked and pre-vetted professionals by Connection Muhimu Network. Applying for the CMN-pro is open to all sellers, new or existing freelancers on the platform.

A seller may offer a service at a base starting price of Ksh. 500/=, other gigs mya be set above this amount but must not below this amount.

A seller should not accept payment through other avenues other than the order made by the buyer on the platform.

For physical deliverables or gigs that require physical delivery, Connection Muhimu Network will not handle and therefore be liable for the quality, shipping, tacking and condition of item being delivered. The seller will take responsibility of the item being delivered and liable for any damages on the item being delivered to the buyer. The additional cost to handle this will be available on the sellers portfolio published just like any other gig, job or service.

3.      BUYERS

A buyer is not permitted to make payment to sellers using an outside payment method or system other than Connection Muhimu Network.

When making an order, the buyer makes a payment of the cost of order to that is withheld by Connection Muhimu Network including a service fee of 5% .

Connection Muhimu Network reserves the right to use all published delivered works for Connection Muhimu Network’s marketing and promotional activities.

Buyers may request for a specific service through the custom order, the service posted must be a service allowed on Connection Muhimu Network. To prevent illegal services, the requested service will be reviewed by Connection Muhimu Network before being aired on the platform, upon approval, the service will be posted.

For custom orders, you may not offer sellers to pay or make payment using any method other than through Connection Muhimu Network platform. In case you have been asked to make payment using other methods, kindly report immediately to customer support or contact customer support.

For physical deliverables, the buyer has to provide a delivery address. The buyer should note that Connection Muhimu Network does not handle delivery, tracking, shipping, security and quality of the item being delivered and is therefore not liable for any damages on the item being delivered.

4.      ORDERS

Once payment is confirmed, your order will be issued an order number starting with

Once your order is issued an order number, the seller will be informed communication will be allowed through the message platform on the platform between the buyer and the seller.

A seller must deliver competed files or proof of work using the deliver work button according to the service that was purchased.

Using the deliver work button without completion of the work may result into suspension of the seller’s account.

An order is marked pending approval on the sellers account after being delivered, once the work is approved by the buyer in their account then the delivered work will change status to order completed and payment reflected on the seller’s account.

An order will be marked completed if not accepted and a correction or modification request is not made to the seller within 3 days after the work is delivered. At which point no correction or modification will be allowed on the work delivered and no refund request will be accepted.

4.1. Handling Orders

When a buyer orders a service, job or gig, the seller is notified through email, SMS and notification on the platform while logged into the account.

Sellers are encouraged to deliver services, jobs or gigs on the specified time upon order and as specified during the creation of the gig, service or job. Failure to deliver on specified time, the buyer may cancel the order and a refund will be made to the buyer for the cost of the order without the service fee. The buyer may also leave a review of late delivery hich may harm the ratings of the seller on the platform.

Users are responsible for scanning the files transferred using the platform for viruses and other harmful malware. Connection Muhimu Network will not be liable for any damage that may occur as a result of site usage, use of content or files transferred on the platform.

If the buyer is not satisfied with the delivered service, job or gig, the buyer may use the request revision button to prompt the seller to make corrections on the order being completed. This should be done with 3 days after the job is delivered.

5.      REFUNDS

The refunds mad to the buyer of a service will not include the service fee charged during the placement of the order or the transaction fees charged. The following are the only incidences where a user is entitled to a refund all other incidences does not warrant a refund from the platform.

1. When a buyer places an order and the order is not delivered within the due date set during the placement of order, the buyer is entitled to a refund totaling to the cost of the service ordered without the service fee charged during placement of order.
2. A buyer is entitled to refund if the seller of the service cancels the order. The amount of refund will not include the service fee charged during placement of the order.
3. If the buyer orders a service and the order is delivered however the buyer is not satisfied with the delivered order, the buyer will not be refunded the full amount, part of the amount paid will be disbursed to the seller for the effort made until the point.
4. The buyer will not be refunded the full amount if the buyer cancels the order before delivery day and one day after the order is placed. Part of the amount will be paid to the seller for the effort made until that point.
5. The partial refund will be 60/40 for the cases where the amount is not refunded in full.

6.      USE CONDUT AND PROTECTION

Requesting and/or providing email addresses, Skype, mobile numbers, or any other personal contact details to communicate outside the Connection Muhimu Network platform in order to circumvent or abuse Connection Muhimu terms of service is not permitted.

Connection Muhimu Network does not guarantee the level service offered to byers. You may file a complaint on before the order is completed in case of an issue with your order.

Any necessary exchange of personal information for purposes of service delivery may be exchanged within the order page.

Connection Muhimu Network does not provide and/or recognize users who interact outside the platform.

All exchange of files or service delivery must be done on the platform

Rude, abusive, improper or violent messages will not be tolerated on the platform and may result into account suspension.

Users are to refrain from spamming or soliciting previous buyers or sellers.

Users may report gigs that may be in violation of the terms of service of Connection Muhimu Network.

Connection Muhimu Network will respond to a clear and concise notice of copyright or patent or any other property right infringement.

Users have the responsibility to report any activity or content that may be in violation of the terms of service of Connection Muhimu Network.

In case of violation or being subject of a complaint or report, your account may receive a warning or account may be suspended.

7.      NON-PERMITED USAGE

Connection Muhimu Network does not allow any exchange of adult oriented or pornographic materials and services

You may not publish or post other people’s private and confidential information on the platform. Any exchange of personal information for service or order completion will only be shared through the order page

Sellers agree not to use any information shared by buyers for any other purpose other than completion of order.

Any user who engages or communicate or conduct activities off of Connection Muhimu Network will not be protected by our terms of service.

Users may not use Connection Muhimu Network for any unlawful purposes or conduct illegal activities

A user is limited to having only one account.

A user are not permitted to Phish or spam other users on the platform

Users who are engaged in targeted abuse towards other users are liable for suspension

You may not buy or sell you Connection Muhimu Network account

Sellers agree to keep any information shared to them on the order page for purposes of order or service completion confidential and private and classified material, not copy or reproduce the information without the buyer’s permission and not use the information other than service delivery.

Connection Muhimu Network does not check or verify the user generated content being uploaded on the platform and therefore is not liable for any intellectual property right infringement. The user (buyer or seller) will be solely liable for the intellectual property right infringement. By offering a service, the seller agree that they have sufficient permission, right and/or license to provide the service.

Connection Muhimu Network is not responsible for the level of quality or level of service being delivered to the buyer (whether the seller is a professional, or otherwise) we provide no warrant for the service being offered by the sellers to the buyers.

When the work is delivered and subject to payment, the buyer is granted all intellectual property right including and not limited to copyright and the seller waives all rights therein. The delivered work, job, gig or service once paid, the buyer will have bought all the intellectual property rights and the seller waives all rights there in.

DESCLAIMER

Your use of the site, its content and service or any other item obtained from the platform is at your own risk. The content, item or services obtained on the platform are provided as is basis without guarantees or warranties of any kind, either expressed or implied. Connection Muhimu Network or any person associated with Connection Muhimu Network makes no warranties for quality of services, item or content on the platform and therefore Connection Muhimu Network or any Person associated with Connection Muhimu Network will not liable for any damages that may be caused by the contents, items be it quality or accuracy available on the platform.

Connection Muhimu Network or anyone associated with Connection Muhimu Network will not be liable with any damages associated with the your use or inability to use the platform or site or any other site or platform its content and items.
